Terms of Service

1. Acceptance of Terms

By creating an account or using 765 Auction ("the Service"), operated at 765auction.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Eligibility & Registration

You must be at least 18 years old to register and bid. You agree to provide accurate registration information, including your name, email address, and phone number, and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Bidding

All bids are binding offers to purchase. By placing a bid, you agree to pay the full invoice amount — including the winning bid amount, buyer's premium, and applicable sales tax — if you are the winning bidder. Bids may not be retracted once placed.

The Service supports maximum (proxy) bids, which automatically bid on your behalf up to your stated maximum. Lots may include a "soft close" feature that extends the closing time when bids are placed near the end of a lot.

4. Payment & Invoices

Winning bidders receive an invoice after the auction ends. Invoices include the winning bid amount, buyer's premium (percentage disclosed on each auction page), and applicable Indiana sales tax. Your card on file will be automatically charged at the end of the auction. If the automatic charge does not go through, payment must be made before picking up your items. If you prefer to pay in cash, please contact 765 Auction at (765) 761-6431 — no card processing fee applies to cash payments. Failure to pay may result in account suspension and forfeiture of won items.

5. Item Pickup & Condition

Items are sold as-is, where-is, with no warranties expressed or implied unless otherwise stated in the lot description. Buyers are responsible for picking up items during the designated pickup times specified for each auction. We are unable to hold or store items — items not picked up during the designated pickup times will be forfeited and the card on file will be charged.

6. Communications & SMS Notifications

By registering, you agree to receive transactional emails related to your account and bidding activity (such as outbid notices, win confirmations, and invoices).

SMS text notifications are optional and off by default. If you provide your mobile phone number and enable SMS notifications in your account settings, you consent to receive automated text messages from 765 Auction about your bidding activity, including outbid alerts, win confirmations, auction start and ending-soon reminders, and payment reminders. Message frequency varies based on your bidding activity. Message and data rates may apply.

You may opt out of SMS messages at any time by replying STOP to any message or by disabling SMS notifications in your account settings. Reply HELP for help. Consent to receive text messages is not required to use the Service or place bids.

7. Prohibited Conduct

You may not: engage in bid manipulation or shill bidding; use automated tools to place bids; create multiple accounts to circumvent restrictions; or interfere with the operation of the Service. Violations may result in bid cancellation and account termination.

8. Limitation of Liability

The Service is provided "as is." To the maximum extent permitted by law, 765 Auction is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including missed bids due to technical issues or connectivity problems.

9. Changes to These Terms

We may update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms.
