Privacy Policy

Account and registration. When you create an account, we collect your name, email address, phone number and mailing address, and a password, which we store only in hashed form. We keep a record of your acceptance of our Terms of Service, including when you accepted and the IP address used. We also store your notification preferences and your choices about marketing emails and marketing text messages.

Bidding, purchases and pickup. We record your activity on the platform, including bids placed, auctions viewed, items won, invoices, payments, refunds, Auction Bucks and reward points, and when purchased items are picked up.

Payments. Card payments are processed by our payment processor, Stripe. Your full card number is never stored on our servers; we keep a reference to your Stripe customer record and a record of each payment.

Tax-exemption documents. If you claim a sales tax exemption, we store the certificate you upload privately, with access limited to authorized staff.

Communications. We keep messages you send us, including replies to our text messages (such as STOP or HELP).

Technical and security information. We record information such as IP addresses and browser details in security and audit logs, and our error-monitoring service may receive technical details when something goes wrong. During sign-up, your browser looks up your public IP address through the ipify service so it can be recorded with your acceptance of our terms.

Direct and Facebook Marketplace sales. When we hold or sell an item to a buyer outside our auctions, such as through Facebook Marketplace, we record the buyer's name, an optional phone number, the agreed price and the payment received.

Merchandise records. We keep business records about the merchandise we sell, such as item details, photos, storage locations and sales history. These records are about merchandise, not about you, except where they are linked to a purchase.

We use your information to:

• Operate your account and process your bids and purchases
• Generate and deliver invoices, process payments and refunds, and arrange pickup
• Manage Auction Bucks and reward points
• Send transactional notifications about your account and bidding activity
• Send marketing emails or text messages only if you have opted in (see Section 3)
• Manage our merchandise and sell it through our auctions, directly, through Facebook Marketplace and on eBay
• Keep the platform secure, prevent fraud and enforce our Terms of Service
• Comply with legal obligations, including tax reporting

We send transactional emails about your account, bids, invoices, payments and pickup. Marketing emails are sent only if you choose to receive them; you can change that choice at any time in your account's notification settings or by contacting us.

SMS notifications are optional and disabled by default. If you provide your mobile phone number and enable SMS notifications in your account settings, we will send you automated text messages about your bidding activity, such as outbid alerts, win confirmations, auction reminders and payment reminders. Marketing text messages are sent only if you separately opt in to them. Message frequency varies based on your bidding activity. Message and data rates may apply.

You can opt out at any time by replying STOP to any message or by disabling SMS notifications in your account settings. Reply HELP for help.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

765 Auction sells some of its merchandise on eBay. With the authorization of 765 Auction's own eBay seller account, our platform connects to eBay's APIs to view that account's listings and keep them consistent with our inventory.

Through this connection we receive our seller account's eBay user ID and username, and information about our own listings, such as titles, prices, quantities and item IDs. The authorization tokens eBay issues are stored encrypted, are used only by our platform, and are erased when the connection is disconnected. Only authorized administrators can connect or disconnect the eBay account.

We do not currently store personal information about eBay buyers. If we receive eBay buyer information in the future to fulfill eBay orders, we will use it only for that purpose and handle it as described in this policy and as eBay requires. Information about eBay's own practices is in eBay's privacy notice.

We do not sell or rent your personal information. We share information only with service providers that help us operate the platform, for the purposes described here, and when required by law:

• Stripe — payment processing
• Resend — email delivery
• Twilio — text message delivery
• DigitalOcean — hosting and storage of the platform and its images
• Sentry — error monitoring
• Cloudflare — Turnstile bot protection on our sign-up and password reset forms, which processes your IP address and browser signals
• OpenAI — AI services our staff use to research and describe merchandise and to help run auctions. When staff use the assistant to look up a customer or prepare a message to a customer, it processes that customer's name, email address, phone number and a summary of their bids and invoices.
• eBay — listing and selling our merchandise through our eBay seller account

We use cookies and similar browser storage that are necessary for the Service to work, such as keeping you signed in and remembering your preferences. We do not use third-party advertising cookies, and we do not currently use third-party analytics. If that changes, we will update this policy.

We use industry-standard security measures to protect your information, including encrypted connections (HTTPS), hashed passwords, encryption of stored eBay authorization tokens, and role-based access controls for our staff. No method of transmission or storage is 100% secure, but we work to protect your data using commercially reasonable safeguards.

We retain account and transaction records as long as your account is active and as required for legal, tax and audit purposes. eBay authorization tokens are erased when the eBay connection is disconnected.

You can:

• Review and update your account and contact information in your account settings
• Change your email and text message preferences at any time, or reply STOP to stop text messages
• Ask us for a copy of the personal information we hold about you, or ask us to correct it
• Ask us to delete your account and personal information (see Section 10)

To make a request, contact us using the details in Section 13. We may need to verify your identity before acting on a request.

You may request deletion of your account and personal information by contacting us. Some records may be retained where required by law, for example for tax, accounting or fraud-prevention purposes.

We are registered to receive eBay's Marketplace Account Deletion notifications. When eBay notifies us that an eBay user has asked for their account and personal data to be deleted, we delete any personal information about that eBay user that we hold, as eBay requires.

Our Service is intended for adults. You must be at least 18 years old to register and bid, and we do not knowingly collect personal information from children.

We may update this Privacy Policy from time to time. We will post the updated policy on this page with a revised "Last updated" date.
